Acceptance and services
By using our website or services, you agree to these terms and our Privacy Policy. Viva Work provides recruitment, candidate introduction, staffing coordination, and related talent services. A separate signed agreement may govern a specific client engagement, and that agreement controls where it conflicts with these terms.
Client responsibilities
Clients must provide accurate role requirements, hiring timelines, compensation information, and lawful workplace expectations. Clients are responsible for their hiring decisions, onboarding, supervision, payroll obligations, and compliance with applicable employment, tax, immigration, data protection, and anti-discrimination laws.
Clients may use candidate information only to evaluate the relevant opportunity and must keep it confidential. Candidates introduced by Viva Work may not be solicited, hired, or engaged outside the agreed commercial terms.
Candidate responsibilities
Candidates must provide accurate, current, and complete information about their identity, qualifications, work history, work authorization, availability, and references. Candidates remain responsible for evaluating any opportunity, negotiating their own terms where applicable, and complying with commitments accepted with a client.
Submitting a profile does not guarantee an interview, placement, employment, contract, or any particular compensation. Candidates must not misrepresent qualifications or use another person information.
Recruitment process
Viva Work may screen, assess, present, or decline to present profiles at its discretion. We do not guarantee the accuracy of information supplied by candidates or clients, and each party should perform the diligence appropriate to its decision.
Neither party may represent Viva Work as an employer, legal adviser, immigration adviser, or authorized agent unless expressly agreed in writing.
Fees and payments
Client fees, payment schedules, replacement terms, taxes, and other commercial terms are defined in the applicable proposal, order, or service agreement. Unless agreed otherwise, invoices are due by the stated due date. Overdue amounts may be subject to reasonable collection costs and lawful interest.
Confidentiality and intellectual property
Non-public business, candidate, compensation, and process information shared through our services is confidential and may be used only for the intended recruitment or staffing purpose. Website content, branding, and materials are owned by Viva Work or its licensors and may not be copied, modified, or used commercially without permission.
Disclaimers and liability
Services are provided on an as-available basis. To the maximum extent permitted by law, Viva Work disclaims warranties not expressly stated in a written agreement. We are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or services.
Nothing in these terms limits liability that cannot legally be limited. Any permitted liability is limited to the fees paid to Viva Work for the service giving rise to the claim during the six months before the event.
Termination, governing law, and contact
We may suspend or end access to the website or services when these terms are breached, security is at risk, or required by law. Provisions that should reasonably survive termination, including confidentiality and payment obligations, will survive.
